We acted for Mr. X who for over 20 years worked for a company which repaired pot holes in Norfolk’s roads. His employers were contracted by Norfolk County Council to carry out such work which also included digging up and relaying asphalt/tarmac.

The work almost always involved the use of air powered tools including air chisels, hammers, and pneumatic drills. The work was dirty and noisy and he was not provided with appropriate protective equipment, nor was the work risk assessed by his employer.

As a result he began to suffer from Vibration White Finger and deafness in both ears. His claim for Vibration White Finger was settled out of Court but his employers continued to deny liability for his ongoing deafness. As a result, the matter was heard at trial where our client was successful and was awarded damages and costs.
