A swimming instructor employed by a local school suffered chronic breathing difficulties which were subsequently diagnosed as asthma. It was subsequently discovered that the heating system to the swimming pool was defective and that the Council had failed to rectify it over a number of years. There was also a suspicion that our client may have been exposed to carbon monoxide poisoning.

Medical reports confirmed industrial asthma caused by the defective heating system. The heating system was eventually totally replaced leading to our client’s symptoms becoming totally resolved.

Despite a prolonged denial of liability, the Council had a change of heart, following the threat to issue Court proceedings, and damages of £8,000.00 was agreed.
