Failure to diagnose ruptured Achilles Tendon

Case Studies » Medical Injuries

Our client, a middle aged man who suffered an injury to his ankle when he fell down some steps, attended the Accident & Emergency Department of a hospital who said that he had merely sprained the ankle and he should gradually try to use it and the pain would ease off. However, after one month of severe pain and going to see his GP, the GP suspected that the man had actually ruptured his Achilles Tendon and sent him back to the hospital immediately, where it was confirmed that he had ruptured his Achilles Tendon. Unfortunately, it was too late by that time to carry out an effective operation to repair the Achilles Tendon, and although he had to go through further pain and inconvenience of having an operation later, it was not successful. Although the hospital tried to argue that it should not be held responsible, claiming that if they had correctly diagnosed the rupture in the first place then the treatment would have been of no significant difference and that it would have made no difference to his recovery, he eventually successfully recovered compensation for the negligence and financial losses for the time involved in his wife and family caring for him when he was unable to walk during his recovery.
