Types of Claim
AIL deal with all types of claim. The
majority of our work includes:
Road traffic accidents
Work place accidents
Tripping/slipping claims
Whilst the majority of claims fall
within one or other of these categories, there are exceptions.
Other claims involve clinical negligence
(against hospitals, GPs, or dentists), industrial disease
(eg for deafness, mesothelioma, or vibration white finger)
and even claims for damage to your hair or negligent
plastic surgery.
If you have been assaulted, then
there is a government scheme known as the Criminal Injuries
Compensation Authority Scheme. Although the amount of
damages that can be recovered is generally lower and
costs cannot always be recovered, it is still worthwhile
bringing a claim if you have been attacked and suffered
injury through no fault of your own.
Some car drivers may be either uninsured
or in the case of a hit and run driver, untraceable.
These claims are dealt with by the Motor Insurers Bureau.
The costs of bringing a claim cannot be recovered in
full for untraced driver claims because the Bureau does
not pay all costs in addition to damages. Even so, it
is usually worthwhile bringing a claim.
If you are at all concerned about
whether a claim can be brought and what effect not being
able to recover all your costs may have on your damages,
then please contact us for an informal
(no charge) discussion.
The golden rule is if in doubt seek our advice.
You
have nothing to lose and quite possibly something to
gain. As a famous Judge once said "the categories
of negligence are never closed". In other words
if you have suffered injury because of somebody else's
negligence then always ask whether a claim is possible.
