Criminal Injury Claims

Ordinarily, if you have an accident which is not your fault where the person who has hurt you has money or is insured, your solicitor will be able to help you to recover compensation for your injuries, loss of earnings and the money you pay out because of the accident.

If the person who has hurt you does not have money or insurance, then you are unlikely to recover compensation no matter how badly you are hurt nor how out of pocket you are unless perhaps you successfully claim for criminal injuries under the current Criminal Injuries Compensation Scheme 2008.

This Scheme is run by the Criminal Injury Compensation Authority (a Government funded body better known as the CICA). Under this Scheme you may still be paid compensation by the Government for your injuries and some of your financial losses which you suffer following a criminal attack on you even if your attacker has no money or insurance to pay you compensation.

When assessing any application for compensation, the CICA will decide the application based on the evidence before it and will not make any award at all unless they are satisfied that the application is acceptable within the rules of the Scheme. There are many factors which are taken into account when assessing your eligibility but the main ones are as follows:-

  1. An application must be submitted to the CICA no later than 2 years after the incident for which a claim is made;
  2. Unless there are good reasons, you must have reported the incident to the police without delay;
  3. You must be seen to have co-operated fully with the police in helping them to attempt to prosecute the offender;
  4. You must have been injured seriously enough to qualify for at least the minimum award available under the Scheme. The minimum award is currently £1,000;
  5. An award may be reduced or withheld if your injury was caused in a fight in which you had voluntarily agreed to take part or if without reasonable cause you struck the first blow or provoked the attack;
  6. An award may be withheld or reduced on the basis of your character as shown by any criminal convictions, even when these are unrelated to the incident for which the claim is made.
